Important Facts About City of Boston Vaccine Mandates

1-Unvaccinated members have until January 15th to comply with vaccination.
2-City Policy states that if the CDC approves a booster/3rd shot, we have 60 days to comply.
3-As of 12/22/21: 96,801 cases of covid in Boston, and 1,494 deaths (98.5% survivability)
4-Average age of covid death in the US is 78 years old.
5-The vaccines do not confer immunity or prevent transmission.
6-Vaccine manufacturers are granted legal indemnity if they cause harm, so we have no recourse if we are injured by the vaccine. The city has informed the union that the city will not cover injuries sustained from the vaccine either. 7-The only available vaccines are under Emergency Use Authorization; the FDA approved “Comirnaty” is not available and is NOT legally the same as the Pfizer-BioNtech vaccine. Emergency Use Authorization (EUA) is issued during public health emergencies which allows for the use of unapproved medical products when there aren’t any approved medical products available. Statutory criteria requires that there are no FDA approved products that exist in order for EUA products to remain available. By definition EUA products are unapproved/experimental. You cannot sue the manufacturers under EUA if you are injured because you sign a release of liability in order to receive the vaccine. While FDA-approved products can be mandated, EUA products must be “voluntary”. You can sue on a very limited basis regarding injuries received from FDA approved products.
8-The available Pfizer, Moderna, and J&J shots are all EUA; the FDA-approved Pfizer “Comirnaty” shot is not currently available. Claims that the Pfizer EUA and the Pfizer Comirnaty
vaccine are the same has been ruled as false by a federal judge. They are two legally distinct drugs. Statutory criteria requires that no approved alternative exist. If it did, they would have to pull the EUA Moderna and EUA J&J from the market. Therefore, you cannot find the FDA approved Comirnaty anywhere. If a vaccination site claims to have it, request to see the vial to prove them wrong. (See both the court ruling and page 6 of the FDA drug fact sheet reference). They can be used “interchangeably”, but you have no legal recourse for injury when you receive the EUA version instead of the FDA approved version.

Call to Action
Claims that we are endangering the public if we aren’t vaccinated just don’t make sense with the above literature. Many of us have natural immunity post infection and we don’t want to accept the risks of an experimental vaccine (however big or small) for something that we don’t need. We have a lawyer and we have motivated members that want to fight this, but we need HELP. We have a matter of weeks before we lose our jobs. For those that are already vaccinated, you will be in the same position as us where you will have to get the booster or lose your job. We pride ourselves in being “First in the Nation” for many things. Let’s be the first in the nation to successfully push back on these mandates and lockdowns.
